(Product shipping and warranty provisions)
The parties state that the products are subject to the provisions of Act V of 2013 on delivery and warranty. (Civil Code) and Consumer
45/2014 on the detailed rules of contracts between a company and an undertaking. (II.26.) Korm.
The provisions of this Regulation shall apply.
The supplier states that food supplements bearing the “BEST LIFE AKTIV” brand can be purchased in its online store. Hereinafter
together: Products.

3. Prices

The prices of the Products are available in euros under the given Product, which include the Tax /VAT/. In the case of an order in Hungary, the invoice will be issued in HUF at the exchange rate of the MNB valid on the day the order is sent. Our customers can find out about the exchange rate here: https://www.mnb.hu/en/arfolyamok. In case of an order from a foreign address, the invoice will be issued only in euros.

4. Terms of Performance

Payment methods:

• Cash on delivery – The invoice will be sent by the supplier together with the product. It is only possible to place an order after a telephone consultation.
• By direct bank transfer – The invoice is sent electronically by the supplier before the delivery of the product
• By credit card payment – via OTP Simple pay system – The invoice is sent electronically before delivery of the product

Order processing:

Orders will be processed on business days within 2 business days, and thereafter, and in the case of prepayment, after payment, the Supplier will deliver the ordered products to the courier service, who will usually deliver the package to you the next day.
There is no delivery on weekends and public holidays.
According to the current VAT law, the transaction is considered completed when the package will be handed over to a courier.

Shipping method:

Delivery of shipments with MPL and GLS courier services happens. After processing the order, as the package to the courier service will be handed over, the courier Service will send a notification via SMS to the specified phone number a the expected delivery date of the package. If for any reason the customer, or the specified consignee is not present at the place indicated on delivery, the shipment is agreed with the courier service at the telephone number provided by the customer re-dispatch.
IMPORTANT! The courier service will only try to ship again once, then return the package to the sender.
After return, the cost of the second delivery is borne by the buyer.
Delivery time:
2-7 business days depending on country
You can predict the route of the package and the delivery date in the system of the courier service based on the specified package tracking number.

Confirmation:

Supplier will send email feedback on all online orders. This means that after you place your order, you will receive an automatic email about the receipt of your order. Please, also check the Spam folder! Correction of errors and deficiencies:

If there is an error or defect in the product or the price in the web store, Supplier reserves the right to make corrections. In this case, after recognizing or modifying the error, Supplier will notify you immediately of any new information. You can then confirm the order again, or it is possible for either party to withdraw from the contract.
Fix data, data entry errors:
You have the opportunity to correct data entry errors before order approval and payment.

You can submit order without registration and through our website order or you can call our staff on +49 89 21547328 or +36 30 546 5390.
If you intend to purchase, select the product, click the “Add to Cart” button at the same time, the quantity you want to buy is in the upper right corner of the screen Add to cart (cart icon).
You can change the quantity you want to buy in the “Quantity” section marked with + and -. If you have a discount coupon, you can validate it by filling in the coupon code field, so that the system will update the price and show the discount price after pressing the “Apply Coupon” button.
By clicking on the “View Basket” button (top right corner of the web store, cart icon) you will find the product in the shopping cart during the purchase.
You can then click on the “Proceed to Checkout” button to see the total amount of your account and the modes of transport available and their costs. You can check your order here in particular the prices and quantities required you can also change it. Your cart will automatically calculate the total amount of your order.
Enter your billing and shipping information, then choose from the payment options available to you want to pay.
If you decided the quantity of products in the basket to be appropriate, checked the grand total and decided you wanted to buy them – then simply click the “Place Order” button. If you want to request the goods to another shipping address, you can also do so on the same page under the billing information. Then proceed as described above.
Please read the General Terms and Conditions and the Privacy Policy and only then, if you agree, click the “Place Order” button. The Supplier will then send you an e-mail informing you of your order to the email address you provided. Buyer confirms all orders placed in the online store at all times and also confirms the acceptance of the current Terms and Conditions.

5. How to handle a complaint

The Supplier will receive complaints at the postal and e-mail address indicated in point 2. For complaints, Supplier will respond within 48 hours on business days. In the event of a dispute, the consumer may apply to the Conciliation Board.

6. Withdrawal from delivery

Supplier shall inform the consumer of the purchase of the product or of several products, if any some products are delivered at a different time than the last one delivered product or, in the case of a product consisting of several lots or pieces, the last one supplied batch or piece, or if the product is sold regularly within a specified period to be provided, to the first service, or to the consumer or to the person designated by him, the by a law of a third party other than the carrier the right to withdraw without justification within 14 (fourteen) days.
Important warning!
In the case of food supplements and packaged foods, Government Decree 45/2014 (II.26.) § 29 of the decree. Pursuant to paragraph 1 (e), the consumer may not exercise the right of withdrawal. The consumer shall have the right to withdraw or terminate in Annex on the form (notice of withdrawal / termination).
The consumer can send the statement to the postal address or e-mail address indicated in point 2. We inform you that the consumer will exercise his right of withdrawal / cancellation in due time if they send the declaration before the deadline indicated above. The foregoing shall not affect the consumer’s right to withdraw from this point between the date of conclusion of the contract and the date of receipt of the product exercise. In the case listed in Annex 2, the consumer does not have a right of withdrawal to exercise. If the consumer withdraws from the contract, he is obliged to use the product immediately, but return it to the Supplier no later than fourteen days after the notification of the withdrawal, or hand it over to a person authorized to receive the product.
The return is considered completed on time if the consumer of the product is on time before expiration.
Important warning! :
Supplier of the product will only take back products in their original, complete, quantitative and qualitative condition. In order to avoid disputes, a vendor can take a photo of the opening of the package containing the returned goods. The cost of returning the product is covered by the consumer. The consumer can only determine the nature, characteristics and functioning of the product and is responsible for depreciation resulting from excess of the required use.

6.1 Refund in case of cancellation

If the consumer withdraws from the contract, the consumer shall withdraw immediately, but not later than than, 14 days of receipt of the statement. The Supplier shall refund it to the consumer, including transport costs (except for additional costs incurred as a result of the consumer offering their chosen mode of transport, other than the cheapest standard mode of transport.)

Refund:
The payment method used in the original transaction shall be the same as that used in the original transaction to Supplier, unless the consumer explicitly consents to the use of another method of payment and; there is no additional cost to the consumer as a result of using this method of reimbursement.

7. Warranty of Supplies

The Supplier shall provide this information in accordance with the model set out in Government Decree 45/2014 (II.26.) that meets the following requirements:

7.1. Supplies Warranty

In what cases can you exercise your right to a warranty on supplies?

You will be liable to the Company in the event of faulty performance of the products marketed by the Supplier who may enforce a warranty claim in accordance with the rules of the Civil Code.

What rights do you have based on your warranty claim?

You can choose to have the following warranty claims: You can request a repair or replacement, unless your needs and choice is impossible to meet or other needs of the business would incur disproportionate additional costs. If you did not request a repair or replacement, you may request a proportionate delivery of the consideration or the fault of the business. You may, at your own expense, repair or otherwise repair or, as a last resort, may also withdraw from the contract. You can switch from your chosen supply warranty to another, but you will be charged the cost, unless it was justified or justified by the undertaking.

What is the deadline for claiming supplies?

You are responsible for the fault immediately after discovering it, but no later than within two months of its discovery. However, please note that beyond the two-year limitation period from the performance of the contract, you can no longer validate it.

Against whom can you assert your warranty claim?

You can assert your warranty claim against the company (Supplier).

What are the other conditions for enforcing your warranty rights?

Within six months from the date of performance, the claim for the warranty of the supplies shall be enforced. There is no other condition other than reporting an error if you certify that the product or service is available and provided by supplier. However, after six months from the date of performance, you are obliged to prove that the defect you recognized already existed at the time of performance.

7.2. Product Warranty

In what cases can you exercise your product warranty right?

In the event of a product defect, you may, at your option, or you can assert a product warranty claim.

What rights do you have based on your product warranty claim?

As a product warranty claim, you only ask to repair or replace the defective product.

In which case is the product considered defective?

A product is defective if it does not meet the quality standards in force at the time of placing order on the market requirements or if it is not included in the description provided by the manufacturer.

What is the deadline for you to enforce your product warranty claim?

Your product warranty claim is valid from the time the product is placed on the market by the manufacturer within one year. Upon expiry of this period, you shall cease to be entitled to do so.

Against whom and under what other conditions can you assert your product warranty claim?

Product warranty claims can only be exercised against the manufacturer or distributor of the movable property. You have to prove a product defect in the event of a product warranty claim.

In which cases is the manufacturer (distributor) released from its product warranty obligation?

The manufacturer (distributor) is only released from its product warranty obligation if customer can prove that:
• Manufactured or marketed the product outside its business activities, obsession.
• The defect is in accordance with the state of the art at the time of placing on the market you were not recognizable.
• The defect in the product is due to the application of legislation or a mandatory official regulation. It is sufficient for the manufacturer (distributor) to prove a reason for the exemption. Please note that due to the same defect, the supply warranty and product warranty claim cannot be asserted simultaneously, in parallel.
Product warranty – However, if the claim is successfully enforced, the product will be replaced or repaired. You can enforce your warranty claim against the manufacturer for this part.

7.3. Warranty

In what cases can you exercise your right to a warranty on supplies?

In case of defective performance, the Contractor is obliged to provide a warranty.

What are your rights and within what period of the warranty?

The warranty claim can be enforced during the warranty period. If under warranty and fail to comply with obligation to summon the claimant within a reasonable time, warranty claims within three months of the deadline set in the notice, can also be enforced in court if the warranty period has expired. Failure to meet this deadline means loss of rights. In order to enforce the warranty claim, the rules governing the exercise of warranty are set by accessories (Section 7.1).

When is the business released from its warranty obligation?

An undertaking shall be released from its warranty obligation only if it proves that that the cause of the error occurred after performance. The supplier draws your attention to the fact that due to the same defect, the warranty and guarantee claim or product warranty and warranty claims cannot be exercised at the same time, not in parallel or otherwise the consumer’s rights under the warranty are set out in Section 7.1. and 7.2. regardless of the rights set out in this point.

8. Information on the terms of the contract

The language of the contract is Hungarian. An order is a written contract. Presently, the Supplier will accept a copy of the GTC with you for each order and an e-mail informing you of the fact of the order will be sent to you, which will be considered by the Supplier as proof of the conclusion of the contract.

9. How to handle and use personal information

Protection of your personal data for Best-Life AKtív Kft. and its partners are a top priority. It is necessary for identification when using our website, the collection and processing of personal data complies with the EU GDPR enforcing data protection legislation.

10. Cookies

The web store uses a “Cookie” to improve the user experience details, as are provided in the data management policy.

12. Consumer Protection

If you notice a violation of the consumer’s rights, you have the right to lodge a complaint to the competent consumer protection authority of the place of residence. After the complaint has been dealt with, an authority shall decide on the conduct of the consumer protection proceedings. Annex 2

Exceptions to the consumer ‘s right of withdrawal and termination. The consumer may not exercise his right of withdrawal

  • a) in the case of a contract for the provision of a service, the whole of the service after the performance, if the business is the performance of the consumer express, in advance started with the consent of the consumer and the consumer acknowledged that the service loses his right to terminate after being fulfilled in full;
  • b) for a product or service for which the price or fee is the money market not controlled by an undertaking, as defined in Section 20 (2) depends on possible fluctuations over time;
  • c) in the case of a non-prefabricated product which is instructed by the consumer or at the express request of the manufacturer, or in the case of a product which: clearly tailored to the consumer;
  • d) in respect of a perishable or short-lived product;
  • e) in the case of a sealed product which is a health or safety product for hygienic reasons, it cannot be returned after it has been opened after delivery;
  • f) for a product which, by its nature, is transferred after delivery inseparably mixed with another product;
  • g) in the case of an alcoholic beverage the actual value of which is an undertaking depends on market fluctuations in a way that cannot be influenced by the parties agreed at the time of concluding the contract of sale, however, the contract shall be performed only after the (30) thirtieth day after the conclusion of the contract;
  • h) in the case of a business contract where the business is express to the consumer upon request, contact the consumer for urgent repair or maintenance work to carry out;
  • i) sealed audio and video recordings and computer software with regard to the sale of a copy of the opened the packaging;
  • j) for newspapers, periodicals and periodicals, subscription contracts except;
  • k) in the case of contracts awarded by public auction;
  • l) contracts for the provision of accommodation, transport, except for housing services, for car rental, catering or leisure activities in the case of a contract for a related service, if the contract a specified deadline or deadline has been set;
  • m) in respect of digital data content provided on a non – tangible medium, if a the business has started with the express prior consent of the consumer, and the consumer has at the same time agreed to acknowledge that that he loses his right of withdrawal after the start of performance.
    In the case specified in point (h) above, the right of withdrawal / cancellation by the consumer used for specifically requested services and used to perform maintenance or repair covers services or products offered in addition to replacement parts.
